How can I avoid a cowboy builder for a garden construction project?

I'm planning a garden construction project that involves a retaining wall and patio. I've got quotes from several builders, and have narrowed it down to a few that I can afford (about £2K). They all have reasonable reputations locally.

Does anyone have any advice on how I can ensure that:
1) The builder stays within budget
2) I have some protection if it goes wrong.

Should there be a contract involved? Also, I've heard that many builders ask for money up front for materials, should I expect this and if so what is the best way to pay etc?

Yes you need a contract. Most builders will ask for 1/2 up front. This is to cover both of you. It covers you so you know you have someone on the job and covers them so they know they are getting paid. Its called a good faith payment.
Your contract can be simple and wrote up yourself. Make sure you put the amount you are paying, amount paid in advance,work to be done and the total budget. Also state that under no circumstance will you pay anymore then the agreed price.
Make sure you both sign it and have a witness there to sign. Make sure your witness is someone you know and not one of his workers.
