how long do i have to sue someone through small claims court in ohio?

this lady totaled ma car by rear ending it on 4.20.11 can i still take her to small claims court?

    Small claims court in Ohio have a $3000 cap. If you seeking more money than that for the damages then you would have to file in a higher court

    The statute of limitations is 2 years from the date of the accident.

    You would have to prove their negligence in causing the accident and prove the damages that you've suffered, among other things. It would probably be best if you spoke with a lawyer so that you can have an understanding of what you will need to do to prepare for the suit. Many lawyers will give a free first consult.

    You might also do your own research by using Google and as many terms, concerning accidents and suing for them, that you can think of and do some reading.
