As of Week 14, the Niners are one game ahead in the NFC West over Seattle, and three games ahead of the Rams. Seattle has a tiebreaker on the Niners, so the Seahawks can win three in a row and host a home game in the playoffs. The Niners could also win three in a row, which could make them no worse than the second seed. One of these two teams should win the NFC Wst. New Orleans will have a say on which teams have a first round bye.

Yes, they are now. Still work to do, though. If Seattle wins out (that includes the week 17 meeting, 49ers @ Seahawks), the Seahawks are #1 pending some tiebreakers (I know they'd lose a tiebreaker to the Saints, TBD on the Packers).
Edit: Seattle wins out, they take the #1 and the 49ers would be a wild card. Seattle also beats out New Orleans (10-2 vs. 9-3 against the conference) and Green Bay (5-0 vs. 3-2 against common opponents, which are CAR, MIN, PHI, and SF; Packers lost to the latter two) in the case of a 3-way tie. If only the Saints tie the Seahawks for the #1, the Saints take it.

Yes they are right now, but if the Seahawks win their last three games of this season, they will win the NFC West and the forty niners will be a wild card.
