    Say a court clerk has decided not to issue marriage licenses, not since her messy divorce. The civil liberties of every couple seeking the necessary license have been violated. They have the right to marry no matter what the clerk thinks of marriage. (And of course that clerk needs firing.)

    But if the clerk denied marriage licenses only to gay couples, or only to mixed-race couples, but issued them to same-race heterosexual couples, it is a civil rights violation.
