Can a 16 year old be arrested and jailed for having sex with an 11 year old?

    This question makes me want to vomit.

    If it's not illegal it should be and consequences should be paid. It doesn't take laws or brain power to know that it is absolutely inappropriate and wrong for a 16 year old teenager to have sex with a child of 11 years old. My God, just six years ago an 11 year old was in kindergarten.

    i guess, but the real question is why would you want to? When i was 16 i was having a go at college girls

    In NYS you are under "Juvenile Offender" status which is not that serious.

    Depending on the state, and the circumstances, it may be treated as rape, or just a juvenile behavioral problem.

    But you can have your children confined in a juvenile home, boarding school, mental hospital, or the foster system, until they are 18, anytime you want.  I would say the parents of the younger child would insist.

    Yep. Sexual contact with someone 11 and under is a felony in most states.

    And the 16-year-old knows better.

      Juveniles CAN be charged with felonies, and they CAN be charged as adults. They just can't be incarnated past age 21.
