Is it possible to get engaged to someone who is already married, but isnt planning to leave their spouse?

Like some sort of conditional engagement, like an agreement to marry IF the current marriage ends

No.  Engagements can not be made until at least there is a formal separation documented with a divorce trial date posted.  A couple has no right to announce an engagement based on something that may never happen or is not definitely going to happen.

You can’t become engaged to any married person, even if the divorce is final the next day. You might have an understanding, but it’s not legally an engagement. And engagements do have a legal side. For example, if a married man gives a woman an engagement ring, she can terminate the “engagement” and keep the ring. An engagement ring is a conditional gift, given in anticipation of marriage. But that condition cannot exist when one party is married.

Your idea is completely pointless.  How and why did this even crop up?  Do you feel you need a ring or a promise on his part to marry you if his marriage ends?  An engagement does represent this promise in a social sense, but people break off engagements all the time.  No laws have been broken.

Also, considering he lies to his wife every day of his life, even if this did represent a promise in your mind, you could believe him?  He's dishonest to the core.

No.  Its stupid in the first place.  If they are not planning on leaving their spouse, why would you want to waste your time with them.

No.  An engagement is a promise to marry.  What you're saying is he will marry you if his wife leaves him...  LOL!  Who would even want someone like that?

    That's adultery.

Yep - being engaged has no legal status whatsoever.

Of course property may be involved. The first thing that comes to mind is an engagement ring. Also, damages when a wedding is canceled by the wish of only one party and a lot of money has been spent.

  • There's no universal legal definition of engaged.

Sure... But would you trust such a spouse?
