Why is Derek Chauvin only being charged with 3rd degree murder when an independent autopsy confirmed that George Floyd died from Asphyxia?

    Mainly because the murder charge was filed before the results of the private autopsy were released. The charge can be changed if prosecutors believe the private autopsy results justify a change.

    Because the DA decided it fitted third degree murder.  Why do you think you know better than a lawyer?

    The charge can be upped if new evidence is discovered. But prosecutors have learned that overcharging often ends in acquittal. This is likely why the charge of manslaughter is tacked on, to give the jury something to convict on if it doesn't feel the evidence supports murder.

    An independent autopsy is not evidence. But the charge of 3rd degree is also not permanent, and if more evidence comes up, there's no reason thy can't change or add additional murder charges.
