No, you gain fat. Excess calories are deposited as fat if you are not doing anything to encourage your body to use those calories for anything else.

Muscle does have weight, so yes it's common for someone building muscle to weigh more on the scales. However, muscle is much more compact than fat, so it takes up less space and is firm (where fat tissue is soft). Yes, it's possible for a very muscular person's weight to be in the overweight to obese range, because the height/weight tables are designed for people of average body composition so don't take into account whether excess weight is fat tissue or muscle tissue. No, it doesn't happen without exercising (muscles decrease in size, without activity).
